mediation or subjugation by Indymac Onewest?Posted: January 21, 2010 by adelle
Hi it's Rick and Adelle again. Well we got the Home re-modification papers. They came from Indymac Mortgage Services in Pasedina , California yesterday afternoon, Jan 20, 2010 at about 3:30 by U. S. priority mail. Let's see, We have received letters and documents from Michigan, Arizona, and we are supposed to mail these to Austin Texas. They came with the wrong address, but we live in an area where the P. O. knows everyone so they were delayed for a day but were delivered. No post date of course so that we could check when they were actually mailed. What a travesty of justice. We both just spent about two or three weeks getting all our financials together and everything else they asked for the mediation. Now we are supposed to get the same exact papers together again and fill out the same exact forms that they just sent us. In addition, on the first page it states we are to have them there by 1/23/2010 including the first trial period payment. That;s two days from now. On page 14 it states that this all has to be there by February 1, 2010. Then there are two more trial period payments due on the 1st of March and April 1st. It was our understanding and the mediators that the first payments would start on March 1. Of course, they also state that this is strictly a trial period and does not guarantee that we will get a home re-modification loan. Our money will not be refunded but if the loan does not go through the trial payments will be applied to other charges that Indymac says have been accrued. We immediately called Kelli the person that we have been working with through Geauga County. She advised that we contact the mediation office, but the mediator is not there on a full time basis, so I left a message. He called back about an hour later and was very surprised that Indymac wanted us to re-send everything they had just received. He gave us the name and phone number of Indymac's attorney and told us to call her and explain the situation to her. He said she was pretty understanding. Again we had to leave a voice mail. She called back about an hour later, just as we both were getting ready to leave for work. She said that she had gotten our rather lengthy message and wanted to know what we were going to do.We told her again about the two dates and that we had just given her all the requested papers about a week ago. She said are you or are you not going to be able to pay the payment and have the papers there by the 23rd? We explained again about the two dates. Her reply was, "so I should tell them that you are going to be late." We said no that we would have everything together by February 1, 2010 but that it was absolutely impossible for us to comply with the January 23 date. First of all its a Saturday and second of all no mail or UPS service could get it to Texas by then even if we could get it all together.. We also said that we did not believe we should have to re-do all these papers again. She said yes we would have to that it was the policy . All during this time she kept talking to us like we were two or three years old and couldn't possibly understand what she was telling us. Very different from the way she acted during the mediation meeting. After that fiasco we left another message with the mediator and that's where we stand now. After reading so many message boards about Indymac we know that this is exactly the way that they operate. Right now we are feeling really low. We have done everything we can and co-operated every way we can and feel like we are getting no where. There has got to be others out there that we can all get together and make a noise about all this. Also there has got be some really good attorneys out there that actually want to help. We also need the politicians to get on board . We were not a sub prime loan. We had a really good credit score. Anyone that has any ideas or knows about anyone who is willing to help or just wants to help us some find some way to get this noticed please let us know. I, too, have Bank of America which was once Countrywide. I have went endured this loan modification process 4 times since 10/08; dealing the Recovery Act, MSHDA and Save the Dream, HOPE, HUD, Springboard, Making Homes Affordable, MSU Extension, etc. only to be told I was approved each time and then the entire paper trail was lost. I have written letters to my governor, senators, ABC and even Obama and have not received any response. Furthermore, one of my initial calls involved a refinance in which I was told my unemployment was not creditable income...only to find out it WAS and I could have been saving over $400 a month since 2/09! What the banks have done is procrastinated this process so people no longer have the 6-month income necessary to substantiate their loan terms. It's angers me that our government refuses to help its' people!
Like some of you, I', a single Mom and full-time student. I spent 20 years in automotive and have returned to college to obtain a Master's for Physician Assistant. I've managed to pay a $989/monthly payment since being laid off 2 1/2 years ago and I'm not sure how much more responsible a person must be to simple modify a loan. I'm not looking for a free handout, by any means, I just need some help to get through school and that is what our almighty government says it's doing...but I beg to differ!
So I completely relate with all of you and I wish you the best in your own search for fairness. Hang in there!

The same exact things have happened with our mortgage company JP MORGAN CHASE. The 'right hand doesn't know what the left hand is doing at chase'. It literally took us since 11/08 until date to get the modification properly in place...and it still isn't! They demanded a down payment, AND they increased our principal amounts, and they are making us pay intrest only for another 10 years in order to get a loan modification. Meaning we will pay over $1,150,000.00 (an extra $200,000.00 over the life of loan), on a house worth $350,000.00! I have had to send JP Morgan Chase copies of their OWN lown modification contracts, and our bank information numerous times! Basically, probably like your bank- they took bailout $ and are pretending to help people.

My husband died 3 yrs ago, no insurance, leaving me to fend for myself. I applied for the HAMP program with my mortgage company in April, 2009. You're right, duplicate forms, duplicate requests for info, different instructions from different counselors. Just this past Friday (after all this time, much agravation, loss of patience, etc.)I have been told I do not qualify. My counselor told me last month not to pay my mortgage note that I HAD been approved and this amount would be incorporated into the recalculated amount that I would pay monthly. I was denied because, even tho' the deed is in both mine and my late husband's name but the note is not. Now she's telling me I'm not financially responsible for my home. Go figure!

I unfortunately understand exactly what you are going through. We are not with Indymac, but are having the same problems with Bank of America. Every paper has a different date and different dollar amount. Every phone call results in different information and hearing "I don't know where they came up with that, but...." I feel like I just want to bang my head on a brick wall. One thing that has helped out has been the NUMEROUS calls I have made to my senators and representatives. I have given specific examples of my problems. They haven't fixed my problems, but they do like knowing what problems we are having. They were surprised to hear how hard the banks are making it for us to keep our homes. Hang in there, you'll get through it.
