updated comments from Little people fighting Indymac

Hi we wrote our story on January 6, and thank you for the people who added their comments.  Here  is an update.  We had our second mediation hearing (without benefit of counsel ) on January 7, 2010.  It is the usual story .  Indymac/OneWest  sent a different attorney, the Indymac Bank representative talked via a speaker on the attorneys cell phone.  Again we were not allowed to present our evidence or the letters that we obtained from the organizations we have been working with,  showing how Indymac has been irresponsible, would not co-operate with anyone or back down in anyway.  By now they have added over $23,000 to our original mortgage.That is what they are basing a payment re-structuring program on.  It has been our understanding that a home re-modification loan is supposed to be  give and take by both parties and then come up with an affordable payment.  Indymac/OneWest's  offer is that they will reduce our monthly payment (perhaps) and then there would be a balloon payment on the end of the loan between $30,000 and $50,000 dollars.  Of course, there is no guarantee at this point that they will even approve this offer. They are still considering it and will let us know in a couple of weeks.    If that is approved we will also be on a three month trial period and then after that if we have been GOOD !!!  they will consider another  permanent loan.   The only good part of the mediation was that Indymac requested more financial information and wanted us to fax it.  We refused stating that we have sent many faxes to Indymac and made many phone calls  over the years and they  all just disappear into thin air.  With that the mediator spoke up and actually said for the record that Indymac HAS A VERY BAD REPUTATION AND IS UNRELIABLE.  Indymac/OneWest's attorney then spoke up and said we could e-mail the information to their office so that there would be a record of receipt and their office would send a confirmation of receipt to us.

We cannot say enough to praise Kelli who is working with us from Geauga County  Economic Development.  She has been a rock in a mire of misinformation.  She is now going to work on another facet of the Indymac problem for us .  This is because of all the problems her office has had with Indymac and no cooperation from Indymac.   We have not heard from a single one of our congressmen or State and U. S.Senators even though we have contacted all of their offices many times and written many letters.  WE appreciate any comments or help that anyone of you reading this can provide.  We are taking any information we receive to Kelli and also keeping our own file .  This is in case we ever hear from any of our government representatives that are actually willing to take a stand and help.
